We want to bring you news of a developing story out of Chester County because it highlights many of the product liability issues we often discuss. Caleb Sturgis, a 25-year-old, died last June after he drank tea made with an herbal supplement called kratom. The medical examiner found that his death was due to mitragynine toxicity due to the consumption of kratom, which is supposed to be a natural pain killer.

The lawsuit filed by the family says that the product “provides no warning label or dosage instructions.”

At the Law Offices of Greg Prosmushkin, P.C., we understand that there are many ways in which wrongful death cases arise. If you have lost a loved one due to the negligence of another person or company, we will work to recover the compensation you deserve. When you need a wrongful death attorney in philadelphia, call us today.

This Case Is Disturbing

Medical records say that Caleb Sturgis drank kratom tea the morning of June 27, 2018, before going to work. On his way there, he crashed his vehicle on the Pennsylvania Turnpike when he struck a curb and his vehicle flipped. His family says the Kratom, as evidenced by the medical examiner’s report, was to blame for the death.

The FDA has begun to issue warnings about Kratom, a product that many say holds promise for treating chronic pain. They have identified at least 44 deaths in the US related to its use. The US Drug Enforcement Agency is looking into banning the product, claiming it is an “Imminent hazard to public safety.”

  • The DEA wants Kratom classified as a Schedule 1 drug, similar to heroin, LSD, and ecstasy.

This case is likely to become a blend of product liability and wrongful death, which means it will be complicated and could take some time before there is a resolution. There are many ways in which wrongful death cases arise aside from defective products:

This is certainly not a complete list. If you think that another person’s negligence contributed to the death of a loved one, always speak with a qualified attorney before making any decisions.
