Last year, Barbara Jones-Davis was wandering alone outside of Enhanced Living at Stapeley, a Pennsylvania retirement home facility. The family of the 78-year-old woman has seen the surveillance footage of her wandering around outside for 23 minutes.

What they do not see, and what happened off camera, was Jones-Davis fall from the property to a concrete sidewalk, a fifteen-foot drop.

At the Law Offices of Greg Prosmushkin, P.C., we know that we expect our loved ones to be looked after when they need to be placed in a home. If you need a Philadelphia Wrongful Death Lawyer, call us today so we can work to secure the compensation you deserve.

What went wrong in this retirement home?

Davis-Jones was found on the sidewalk by a bystander who called 911. She had fractured her skull and suffered from a brain bleed in addition to several other broken bones. She passed away that night.

Her family has brought a lawsuit against Stapeley as well as the firm that provides security at the facility. They say that Jones-Davis’ death was “totally preventable.”

An attorney for the family says they want to know exactly what happened and are aiming to improve security at the facility so this does not have to happen to anyone else.

They say that Davis-Jones had a history of wandering and that they had told the facility they believed she needed closer supervision. The facility does have options for controlling movement, including wearable ankle and wrist monitors that trigger alarms when a person passes through certain doorways.

A injury will be the ultimate decider of whether or not the retirement home was responsible for her death, but there are many times when other people’s negligence or carelessness contribute to the death of others. Consider these other common ways in which wrongful death cases arise:

  • Drunk Driving Incidents
  • Distracted Driving Incidents
  • Workplace Accidents
  • Faulty Products
  • Excessive police force
  • Pedestrian/bicycle crashes
  • Medical Errors
  • Boating accidents

This list is only a snapshot of possible wrongful death cases. You should always speak with an attorney before making any decisions. Wrongful death cases can be brought by surviving family members or a person’s estate against individuals, groups, agencies, or companies believed to be responsible for the death.
