Mothers Against Drunk Drivers (‘MADD’) is not very impressed with the State of New Jersey’s drunk driving prevention efforts and our Cherry Hill DWI Accident Attorneys have to agree. MADD gives New Jersey 2 out of 5 stars as far as implementing countermeasures that reduce the instances of drunk driving.

Reduced drunk driving, of course, reduces Auto Accident injuries and fatalities. Our attorneys at The Law Offices of Greg Prosmushkin, P.C. have worked tirelessly to recover for our clients who have sustained injuries or lost loved ones in DWI accidents because we believe that drinking and driving is a danger that can and should be completely eliminated.

There is simply no reason that DWI accidents still happen and that innocent victims and their families suffer as a result.

Impact of Third Party Liability in DUI crashes

Something that the state of New Jersey does do right is that it allows Drunk Driving victims to recover from multiple parties in some cases of drunk driving accidents.

When a drunk driver is solely liable for a drunk driving accident, there may not be enough resources between the driver and his or her insurance company to cover the extent of the victim’s injuries and damages.

When liability is opened up to third parties who are at least partially responsible for the accident, there are more recovery options available for the plaintiff.

  • Dram Shop Laws – New Jersey dram shop laws provide that a seller of alcohol may be liable for selling alcohol to a visibly intoxicated patron or to a person who is under 21 when that person subsequently gets into a DWI accident causing injuries to an innocent accident victim.
  • Social Host Laws – New Jersey law provides that a social host may be liable in some situations where alcohol is served to a visibly intoxicated guest in a reckless manner with no regard for the harm to life or property that could result.
  • If that intoxicated guest then gets behind the wheel and causes an accident, the innocent injured parties may name the social host as a defendant.

Insurance Companies In DUI Cases

When a driver and a social host or alcohol seller are involved in a DWI accident claim, you can imagine that things do not often get settled smoothly.

Multiple insurance companies will generally deny liability and place blame on each other in order to protect their own interests in keeping the amount of their payout as small as possible. Not only is it unfair to the injured victim/s, but it can make for a very drawn out recovery process.

Our Cherry Hill DWI Accident Attorneys are passionate advocates for drunk driving victims. Drunk driving is a senseless and preventative crime that has hurt and killed many innocent people and their family members.
