The Obama Administration Introduced Deferred Action for Childhood Arrivals as a means for immigrants who were brought into the United States as children to defer their removal from the country. The guidelines of eligibility state that an applicant can be eligible for Deferred Action for Childhood Arrivals if:
- The client is under the age of 31 as of June 15, 2012.
- The client came to the United States before reaching their 16th birthday.
- The client has continuously resided in the United States for at least 5 years.
- The client was physically present in the United States on June 15, 2012, and at the time of making his/her request for consideration of deferred action.
- The client entered without inspection before June 15, 2012, or his/her lawful immigration status expired as of June 15, 2012.
- The client is currently in school, has graduated or obtained a certificate of completion from high school, has obtained a General Education Development (GED) certificate, or was an honorably discharged veteran of the Coast Guard or Armed Forces of the United States.
- The client has not been convicted of a felony, a significant misdemeanor, or three or more other misdemeanors, and does not pose a threat to national security or public safety.
This new change is especially important for clients or the children of clients who are just now reaching the driving age, seeking to continue their education, or looking to legally enter the U.S. workforce. While deferred action does not ensure citizenship, it does give clients more time to live and work in the country without accruing time as an unlawful resident.As with all forms, it is essential that every aspect is filled out correctly in order to ensure no mistakes hinder a client’s chances of obtaining deferred action.
