What’s Happening in This Ongoing Case?
Francine Roth is still working on Getting Compensation for her slip and fall incident at a Target store. We recently learned that the Eastern District of Pennsylvania US District Court granted Roth’s motion to remand her case back to state court. The judge in the case said that Target took too long to remove her case to federal court.
Francine Roth filed a lawsuit in November 2018, saying that the suffered injuries from a fall in a Bensalem Target in 2017. She asked for over $50,000 plus legal costs and delay damages.
Roth says she slipped on a “liquid” substance on the floor of the store and “suffered a cosmetic disfigurement, and she may continue to suffer (the) same for an indefinite amount of time.”
Slip and Falls are Highly Dangerous
Many people do not think that slip and fall incidents are serious, but they are the number one cause of injuries in Premises Liability Cases. It is not uncommon for us to see the following injuries as a result of a slip and fall incident:
- Broken or dislocated bones
- Severe lacerations
- Whiplash injuries
- Head injuries
- Spinal Cord Injuries
- Bone bruises
In the case above, we do not know how Ms. Roth was disfigured, but this could lead to significant emotional and psychological damages.
All too often, we find that Slip and Fall incidents are preventable. However, they cause approximately a million people To Seek Treatment in hospitals each year, according to the NFSI. They primarily occur due to:
- Floors wet from spills or leaks
- Failure to put up a wet floor sign
- Improper mopping techniques
- Loose carpeting
- Loose floorboards or stairs
- Uneven walking surfaces
